Criminal Injuries Compensation Claims
Prison Officers who are assaulted during the course of their duties may be entitled to bring a claim to the Criminal Injuries Compensation Tribunal. We have many years of experience processing such claims before the Tribunal. The Tribunal awards general damages (for pain and suffering) and special damages (for items such as loss of earnings, medical bills etc.) The first stage of the process is one whereby an application is made on paper. We instruct relevant medical experts, obtain reports and provide these to the Tribunal with a summary of the case and details of the expense and quantum of the claim. We advise as to whether or not the award should be accepted or rejected. If it is rejected, we will represent the Prison Officer at the hearing before the Tribunal and if appropriate, instruct Counsel.
Work-Related Injury Claims
If you in the course of your duties sustain an injury at work, we are in a position to advise you and if appropriate, lodge an application with the Injuries Board. Subsequently, if appropriate, we can assist you in launching proceedings in the relevant court. We have represented Prison Officers in all types of accidents at work including:-
- Injuries caused by assault and the failure of the Prison Service to provide adequate numbers of staff to prevent injuries.
- Slip and fall cases.
- Injuries sustained during the course of control and restraint of prisoners.
