Pub, Bar or Nightclub Accident Claims

Pub, Bar or Nightclub Accident Solicitors

The combination of alcohol consumption, high spirits and low lighting means that, unfortunately, pub and bar accidents are common.

If you have been injured in an accident in a pub, bar or nightclub in Ireland, you may be entitled to bring Personal Injury Claim – this type of claim is referred to as a Public Liability Claim and/or an Occupier’s Liability Claim.

These cases can be complex – for advice on how to proceed with your claim, contact an experienced Solicitor.

Most pubs, bars and nightclubs in Ireland have Public Liability Insurance for incidents and accidents.

If your accident is due to any type of negligence, then you may have a claim.

Types of Pub/Bar/Nightclub Accident Claims

Pubs, bars and nightclubs have a duty of care to you and all their customers.

To ensure your safety, they must carefully manage all risks. This includes preventing overcrowding, ensuring spillages and breakages are quickly dealt with and that staff are properly trained.

The following are some injuries/accidents which are common in pubs and bars:

  1. Slips and falls caused by uneven or wet floors.
  1. Injuries caused by broken glass.
  1. Injuries arising from overcrowding An overcrowded public house, bar or nightclub can lead to a crush or impede security staff from being able to get to different areas of the pub/bar to prevent fights.
  1. Injuries relating to food and drinks are also relatively common. When food and drinks are not prepared properly then a customer can become ill. Likewise, a burn or scald from hot food can lead to a claim.
  1. Injuries caused by fights in a pub or club or the negligent management of a brawl by the security staff.
  1. Injuries caused to staff as a result of manual handling (such as carrying boxes and kegs) or injuries arising from an assault.
  1. Injuries caused by a drunk customer who should not have been admitted (or who should have been ejected sooner).

If you have been injured by any of these or any other type of bar/pub/nightclub accident, contact your Solicitor.

Who Can Claim After A Pub or Bar Accident?

Customers, staff and any person on the property who suffered an injury as a result of an accident in a pub or club may be able to make a claim for injuries suffered.

What To Do Following An Accident In A Pub, Bar or Nightclub

The most important step following an accident in a pub, bar or nightclub is to ensure you receive the right medical treatment. Only once you have done this should you proceed with further steps. If you are leaving the establishment for treatment, notify a member of staff of your accident first.

  1. Report the accident to the establishment.
  2. Notify Gardai (if appropriate e.g. if you were assaulted).
  3. Take pictures of your injuries (and the area where the accident occurred, if possible). This is best done as quickly as possible.
  4. Compile a note of the circumstances of the accident, including taking note of any witnesses. Write down who was with you, who was around you and who was involved.
  5. Contact your Solicitor.

Why Claim Quickly Following An Accident In A Pub Or Bar?

The Statute of Limitations provides that the time limit for bringing a Personal Injury Claim is 2 years from the date of the accident, but on occasions, the time limits may be shorter or longer. The wrongdoer must also be notified of the claim within 1 month of the accident.
