part-time employees.

What are the Causes of Back Injuries?

Back injuries can occur due to various factors and causes, some common causes of back injuries at work include:

  • Lifting heavy objects incorrectly or using improper lifting techniques.
  • Engaging in repetitive activities that involve bending, twisting, or lifting.
  • Prolonged periods of sitting or standing with poor posture.
  • Work environments that involve physically demanding tasks.

What Should I Do If I Have A Back Accident At Work?

If you experience a back injury at work, the first thing to do is to seek medical attention.
Then, when it is safe to do so, you should:

  1. Report the incident to your employer and follow your workplace’s procedures for
    reporting accidents or injuries.
  2. Gather evidence. This may include photographs of the accident scene, witness
    statements, medical reports, and any other relevant documentation.
  3. Consult with an experienced Personal Injury Solicitor. Your Solicitor will help you prepare and submit the necessary documentation for the back injury claim. This will include a letter of claim to the employer. This letter outlines how you suffered a back injury at work, your injuries, and call for damages to be paid. Your employer, or their insurer, will investigate the claim. If a settlement cannot be reached, your Solicitor will represent you during the legal process of obtaining compensation for the injury suffered at work.

What Are The Time Limits For Making A Back Accident at Work Injury Claim?

In Ireland, there are specific time limits, known as the Statute of Limitations, in which to claim compensation. This relates to all personal injury cases, including workplace accidents.

The Statute of Limitations provides that the time limit for bringing a personal injury claim is 2 years, but on occasions, the time limits may be shorter or longer. For example, in some cases, claims can be brought later than the 2 year time period. For instance, if an employee is exposed to a chemical that causes illness but the connection is not made until much later.

With a workplace accident, it is advisable that you start the process of making your claim as soon as possible. By beginning the process as soon after the accident as possible, you are giving yourself the best chance of success.

Sometimes, establishing the “start date” of the time limit is not straight forward. For example, it can be difficult to establish the start date for injuries arising from a Repetitive Strain Injury. A Personal Injuries Solicitor will be able to help advise on the start date.
