EMPLOYEE RECEIVES COMPENSATION FOR ACCIDENT AT WORK

Jody Cantillon, of the Litigation Team in Cantillons Solicitors, recently successfully obtained compensation for a client who suffered injuries, loss and damage, following an accident at work.

Our client was working on the factory floor underneath machinery when, due to a defect in the machinery overhead, an object fell from above and struck our client causing personal injuries.

An application was made to PIAB (formerly the Injuries Board) and the Defendant refused to engage with the PIAB process.   Thereafter, Circuit Court Personal Injuries Proceedings issued.  Whilst liability was denied and the Defendant made allegations of contributory negligence against our client, due to pressure applied to the Defendant by Cantillons Solicitors, the Defendant ultimately made a significant offer for the injuries, loss and damage suffered.

The matter settled without the need for our client to give evidence in Court, and the Defendant was also required to pay our client’s legal fees.
