Substantial Interim Settlement for Six Year Old Girl who suffered Significant Injuries at Birth due to Negligence

Karen Kearney and Ernest Cantillon of the Medical Negligence team at Cantillons Solicitors  achieved a significant settlement on the 28th September 2023, with the State Claims Agency for the HSE at Mediation by way of a payment out of €850,000 for a period of five years to our client,   a six year old little girl. The settlement was approved  (Ruled)  by the High  Court on the 11th October 2023.

This was a very complex medical negligence matter.

Our client  sustained both physical and mental injuries at birth at University Maternity Hospital Limerick on the 22nd  February 2017.

There were some admissions of negligence by the Defendants  to include failing to monitor the fetal heartrate during the second stage of labour (it seems that the midwife mistook the maternal pulse from the fetal heart rate),  failing to recognise and act on a pathological CTG tracing from 15:10 hours (some 70 minutes prior to delivery) and inappropriate admission of  Syntocinon  again some 70 minutes prior to delivery.

However, causation  was denied throughout the duration of the claim and indeed continues to remain an issue for the adjourned Trial  of the matter in October 2028.

We are delighted that the significant interim payment will help this little girl’s parents  buy the therapy, care, aids and appliances  etc  that she needs  for the next five years to help maximise her potential. The current public system is not fit for purpose.

We are  also delighted to secure significant  settlements for her parents   for the psychological injuries that they suffered as a consequence of the Defendants’’ negligence.
