Significant Settlement of Case for Woman who lost the function of her right dominant upper limb due to a substandard delay in treating and diagnosing her metastatic disease

Aisling Maher, assisted by Mags O’Shea, recently achieved a significant out-of-court settlement for a lovely woman in respect of a substandard delay in diagnosing and treating her right axillary/brachial plexus metastatic HER2 positive breast cancer at Cork University Hospital (“CUH”), from approximately April 2018 to February 2019 (when the diagnosis was made). During the aforementioned period, the Plaintiff had been bringing her concerns about the increasing pain/numbness/tingling/loss of function she was experiencing in her right arm/shoulder/wrist/hand on a consistent basis to the oncology team at CUH when she attended there for her 3 weekly maintenance treatment. Investigations concluded by Cantillons on her behalf confirmed that a timelier diagnosis and treatment of her metastatic cancer would have improved her prognosis with respect to the function in her dominant upper limb. Sadly, by late 2018, due to the delays that had occurred, she had lost function in same and has not regained same following treatment. Liability was fought by the Defendant until two days pre-trial when our client was invited to mediate her claim. It is hoped that the award achieved will enable our client to engage the help and therapies she so desperately requires and deserves, so as to ensure she can live as independent as possible a life into the future.
