Settlement of €2million compensation following workplace assault causing life changing injuries

Posted in News on Thursday, December 21st, 2023

Sarah McNulty and the Litigation Team at Cantillons obtained a substantial settlement for a man who suffered catastrophic injuries as a result of a vicious attack perpetrated against him at his place of work during the course of his employment. Our client was an innocent victim who was set upon by criminals. There was a failure by the employer and the business park owners to have adequate security measures and safety procedures in place to protect our client.

The impact of the life changing injuries arising from the attack had a devastating impact on our client. The permanent nature of his extensive physical and psychological injuries means that he will not be in a position to return to work and has significant long term care needs.

The Defendants denied liability and also alleged that our client contributed to the negligence. This was most upsetting for our client. It was necessary to conduct extensive investigation into establishing liability. Ultimately, it transpired that there was no evidential basis for the allegations made against our client and they were formally withdrawn.

The matter was listed for hearing before the High Court and ultimately settled resulting in significant compensation being paid out to our client. The settlement was obtained without our client having to give evidence. The Defendant was required to pay for our client’s legal costs.

* In contentious business, a Solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement.  Many Personal Injury Solicitors portray themselves as “no win no fee Solicitors Cork”. This term can be misleading and it is essential that you discuss fees with the Personal Injury Solicitor you ultimately choose. At Cantillons Solicitors, we are entirely transparent.
