Settlement achieved for a Mother who lost her darling Daughter as a result of cardiac complications following treatment for Hodgkin’s Lymphoma

The medical negligence team at Cantillons settled a fatal claim for the Mother arising out of medical negligence in relation to the death of her daughter (“the Deceased”) who sadly died because of cardiac complications. The Deceased, who was then a teenager, was diagnosed with Hodgkin’s Lymphoma (“HL”). Although a devastating diagnosis, with the correct treatment regime for HL, the disease is eminently curable with chemotherapy alone or in combination with radiation therapy. However, there are potential adverse complications due to radiotherapy and a particular chemotherapy that can affect the heart, which can be acute or latent following completion of treatment. We were able to establish that the Defendants had failed the Deceased and prescribed a substandard chemotherapy regime that was not and is not a typical regime used for the treatment of HL. Secondly, the Defendants prescription of radiotherapy was substandard and in addition, used an outmoded machine which delivered radiation to a large area of the in the upper half of the body rather than using a more modern machine which delivered the radiation to the specific areas of HL. Thus, the treatment regime caused damage to the Deceased’s heart and ultimately, her death. The case settled by way of mediation and although there was a substantial financial award, more importantly for the Mother she was afforded the opportunity of meeting one of the treating Doctors and obtained a verbal and written apology from the hospitals concerned, which she found highly beneficial and finally she felt vindicated.
