Interim Settlement of €1.5M agreed for Young Girl who was Brain Damaged at Birth

Karen Kearney, Ernest Cantillon and the Medical Negligence Team at Cantillons Solicitors were delighted to assist Clodagh Walsh and her parents, in securing an interim settlement of €1, 500,000 together with costs. This interim settlement will ensure that Clodagh has all the care and therapies she needs for the next six years when her case comes before the Court again on the 22nd October 2025.
The settlement was reached after a lengthy battle with the HSE which commenced when we were first instructed by Clodagh’s parents in April 2014. Following our investigations, it was clear that the care afforded to Clodagh’s mum during her birth and delivery at South Tipperary General Hospital on the 3rd February 2009, was inappropriate. However, it was only in July 2018, that liability and causation was admitted by the Defendant, some 9 years after Clodagh’s birth.
Approving the settlement on the 29th October 2019, Mr. Justice Cross commended Clodagh’s parents for the way that they have taken care of her. Indeed, they have left no stone unturned to ensure the very best for their beautiful, courageous daughter Clodagh.
