Employee successfully sues for Constructive Dismissal

Sinead Carroll and Mary Scriven successfully sued an employer for effectively dismissing their employee after many years’ service without any warning. The lady in question was called to a meeting out of the blue, accused of stealing (which she denied and was untrue) and was threatened with criminal proceedings. This caused such upset and humiliation to the woman, that she felt she could never return to that place of work. The team lodged a claim with the Workplace Relations Commission and the Adjudication Officer agreed that there had been constructive dismissal and that it was entirely reasonable for the lady to have resigned. She was awarded compensation.
