Do Car Accident Claims Go To Court?

It is possible, but not inevitable, that Car Accident Claims in Ireland will end up being heard before a Judge in Court.

Car Accident Claims are dealt with, in the first instance, by the Personal Injury Assessment Board (PIAB). PIAB, sometimes referred to as the Injuries Board, was set up to keep claims like those that arise from car accidents out of Court and the costs low.

If your claim for compensation is accepted into the PIAB process, an assessment will be made, having considered various medical reports etc. You will receive an offer of compensation, which (if you accept the award), will be paid to you by the party at fault in your case. You will have 28 days to decide whether to accept this offer. The party at fault has 21 days to accept or reject the offer.

If both parties accept the assessment, then you should receive your compensation payment, and your case will be considered resolved.

If either party rejects the offer, the next step, should you wish to do so, is to bring Court proceedings, where a Judge will decide the outcome of your case.

When Court proceedings are brought in relation to a car accident claim, it is not definite that the case will actually have to be heard in Court, before a Judge. Cases often settle out of court prior to the trial.
