Uninsured Driver Accident Claims

Uninsured Driver Accident Claims

Anyone driving a motor vehicle on Irish roads is required to have motor insurance.

Generally, if you are involved in a road traffic accident that is the fault of another driver, it is that driver’s insurance company that will cover your compensation.

What if the driver responsible for causing a car accident is not insured or not traceable?

You might still be able to bring a Personal Injuries Claim.

If you have been injured in an accident caused by an uninsured driver, contact Cantillons’ leading Personal Injury Solicitors for assistance with your Uninsured Driver Claim. What Is An Uninsured Driver Accident Claim?

An Uninsured Driver Accident Claim is a type of Personal Injury Claim that can be made following a motor vehicle accident with an uninsured. You may also be entitled to make an Uninsured Driver Accident Claim if the driver who caused the accident failed to stop at the scene, cannot be traced or gave fake/incorrect insurance details.

When an uninsured driver, or untraced driver, is involved in an accident, resulting in injuries to another party, the injured party may bring a Personal Injury Claim against the Motor Industry Bureau of Ireland.

What Is The Motor Insurers Bureau of Ireland?

The Motor Insurers Bureau of Ireland (MIBI) is an organisation established (and funded) by motor insurance companies in 1955 to help people injured by untraced or uninsured drivers.

When an Uninsured Driver Accident Claim is made in Ireland, it is generally the Motor Insurers Bureau of Ireland that pays the compensation.

Who Can Make An Uninsured Driver Accident Claim?

Anyone injured due to negligence or wrongdoing of an uninsured driver can make an Uninsured Driver Claim. Such persons include:

  • Other drivers involved in the accident.
  • Passengers in the uninsured driver’s car.
  • Passengers in any other vehicles involved in the accident.
  • Cyclists.
  • Pedestrians.

What Can Be Claimed In An Uninsured Driver Accident Claim?

Uninsured driver accident claims typically cover:

  • Pain and Suffering

As with all Personal Injury Claims, compensation for the physical pain and emotional distress caused by the accident can be claimed.

  • Medical Expenses

If your injuries result in you needing medical treatment, rehabilitation, or any ongoing healthcare support, these can be claimed.

  • Loss of Income

If your injuries prevent you from working, you may include a claim for lost wages.

  • Property Damage

Reimbursement for damage to your vehicle or other personal property caused by the accident can, in some incidents, be included in the Uninsured Driver Accident Claim.

When To Make An Uninsured Driver Accident Claim?

There are strict time limits within which Uninsured Driver Accident Claims must be taken.

Generally speaking, the time limit (the Statute of Limitations) is 2 years but on occasions, the time limits may be shorter or longer. There are some exceptions to the 2-year rule. For example, for compensation claims cases involving children, the time limit may be extended to 2 years after the child’s 18th birthday.

We recommend you begin your uninsured driver claims process as early as possible.

How To Make An Uninsured Driver Accident Claim?

After a car accident, it is standard procedure for the drivers involved to exchange contact details and the details of their insurance company.

If the driver at fault is not insured, take down as many other details as possible such as their name, telephone number, address and car registration details. You should also contact the Gardai and your insurer as soon as possible.

Following the accident, you should contact an experienced Personal Injury Solicitor who will be able to advise you on your claim and the necessary steps,  including notifying the MIBI.

What To Do If The Other Driver Does Not Stop At The Scene Of An Accident

If you are involved in a hit-and-run accident, call the Gardai immediately. If you or anyone is injured in the accident, call 999 or 112 for an Ambulance. Do not try to follow the driver who left the scene.

* In contentious business, a Solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement. You might come across Car Accident Solicitors portraying themselves as ‘no win no fee’ Solicitors. These terms can be misleading and you must discuss fees with the Personal Injury Solicitor you ultimately choose. At Cantillons Solicitors, we pride ourselves on being entirely transparent about our processes and fees.
