The litigation team were successful in achieving a very significant award of damages in a case involving complex, life changing injuries suffered by a client.

As a result of a road traffic accident, the client suffered neck and back injuries and was caused to strike their head on impact. While the neck and back complaint settled within months, the client suffered debilitating headaches for more than four years post-accident. While the defendants admitted liability, they argued that they were not responsible for the significant loss of earnings incurred by the client. The client in question had secured a full-time job at the time of the accident, having worked part time during child rearing years, but was unable to take up the position due to her injuries.

The litigation team worked closely with an expert to establish that the injury impaired the client’s brain function, in certain areas, to the extent that it would have hampered her  efforts at re-training and/or working in a new environment.

The settlement achieved represented four times the amount tendered by the insurance company during the progression of the case.
