Substantial settlement for prison officer who suffered injuries due to a workplace accident

The Litigation Team at Cantillons recently negotiated a substantial settlement for a prison officer who suffered back injuries due to a workplace accident. Our client was a poor candidate for an accident of this nature, as she had a significant pre-accident history of back injuries, having undergone two previous surgeries on her back. An application was lodged with PIAB in the usual course and the PIAB assessment was rejected by our client in accordance with our advice. Proceedings issued for the High Court. While her employer admitted responsibility for her accident, their solicitors argued that her ongoing difficulties would have arisen regardless of this accident, given her previous back problems. It was clear from our client’s instructions that this was not the case and that prior to the accident, while she had some intermittent pain, she had worked full time, albeit on restricted duties, without any difficulty. Following this accident, she was caused to experience constant pain which was exacerbated when she was seated or standing. Her restricted duties meant that she was seated for prolonged periods. As a result, she was left in agony and was regularly unfit for work. She also incurred significant costs for pain management procedures which were essential to allow her to work. The team at Cantillons worked closely with our client’s doctors to establish the extent of the injuries directly related to the accident and accordingly, she was compensated appropriately for the pain and suffering she endured. She was reimbursed for all treatment she had received. Her legal costs were discharged by the defendant’s solicitors and ultimately the net settlement she received equated to almost twice the figure assessed by PIAB in accordance with the book of quantum, the method for assessing compensation in place at the time of the accident.
