Substantial Compensation due to Surgical Error in Gallbladder surgery

Karen Kearney ably assisted by Tricia Sisk and April Wiseman and the Cantillons Team secured substantial compensation for a client who suffered significant life threatening injuries following gall bladder surgery.
During the surgery and as a consequence of the Surgeon’s negligence, our client suffered a complete transection of his common hepatic duct and furthermore, and also due to negligence, there was a failure to repair the gall bladder duodenum fistula which caused localised peritonitis.
Prior to the surgery, our client, in his 60’s, was a fit active man.
Following the surgery, our client suffered from sepsis, and spent many months in hospital including in the ICU.
He lost a significant amount of weight.
He was left with extensive scarring.
He suffered from PTSD.
He had and continues to have difficulties with certain activities of daily living.
The Surgeon who had performed his surgery retired within days of performing the surgery.
Our client came to Cantillons looking for answers to the many questions he had about the appropriateness of the care afforded to him.
We set about getting those answers.
We took up his medical records.
We commissioned a report from a world renowned Expert Physician in this field to review the records and furnish a medico-legal report and this expert confirmed medical negligence and causation (namely that the negligence caused the injuries).
We proceeded with a case in the High Court for our client claiming compensation for his pain and suffering and his out of pocket expenses.
Liability was denied for the duration of the case. This added greatly to our client’s stress.
But we continued to press the Defendants to admit liability/ negligence which they finally did, but only after failed Mediation and some 8 weeks prior to the hearing date of the case.
It was settled 4 weeks approximately prior to the hearing date for a significant sum for our client.
It was a case with many twists and turns and complex issues regarding the negligence, causation and injuries.
