Six figure settlement for plaintiff with underlying neurological condition injured as a result of a high velocity road traffic accident

The team at Cantillons, recently achieved a significant settlement for a client who suffered soft tissues injuries as a result of a road traffic accident.  Our client was a poor candidate for an accident of this nature, having been diagnosed with a degenerative, neurological condition mere months before the accident.  As a result of the collision, our client suffered injuries to her back, hips and pelvis. She also experienced a rapid acceleration in the progression of her neurological condition.

An application was lodged with the Personal Injuries Assessment Board but due to the complexity of issues involved, PIAB declined to make an assessment of damages. High Court Personal injuries proceedings ensued.

The Defendants refused to accept the impact of the accident on the Plaintiff’s condition and argued that her condition would have progressed regardless of any accident and that compensation ought only be payable for the soft tissue injuries she had sustained. Their Solicitors filed a Tender of less than €80,000.00. Based on Cantillon’s advices, our client rejected the offer. The team at Cantillons worked closely with our client’s treating practitioners to secure reports which accurately established the causal link between the Plaintiff’s inability to exercise due to the injuries sustained as a result of the accident and the acceleration of her neurological condition. The case ultimately settled, without the requirement of a court attendance, for a settlement offer representing multiple times the value of the Tender. The Defendants discharged the Plaintiff’s legal costs as part of the settlement.
