Significant compensation for worker injured due to a workplace accident

The Litigation Team at Cantillons, assisted by Carmel Craven, recently negotiated a significant settlement for a client injured as a result of a workplace accident.
Our client was operating a drill, with a hole-saw attached, to cut a circular pipe when the saw was caused to jerk resulting in a nasty laceration to his finger. The team at Cantillons established that the cause of the accident arose due to two factors; firstly, the equipment provided was not suitable for drilling holes in circular pipework and secondly, the attachments utilised were not regularly replaced and as a result became worn resulting in a ‘jerking’ movement on operation. By failing to take any, or any adequate steps, to correct these issues, we argued that our client’s employer was negligent and that this negligence caused our client’s injury.
An application was made to PIAB in the usual course and on Cantillon’s advices, the PIAB assessment of damages was declined by our client. High Court proceedings were initiated. Liability was contested, but ultimately, a settlement representing a significant uplift on the PIAB assessment was achieved within 6 months of the date of initiation of proceedings. The Defendants paid our client’s legal costs.
