Settlement for Urology Medical Negligence

Orla Kelly assisted by Angela O’Donovan and Michelle Horgan in the Medical Negligence Department assisted a deserving couple in proceedings, arising out of the negligent medical treatment at a hospital and by his Consultant Urologist.

His case concerned the fact that he was advised to undergo a urological surgery which was inappropriate for him and without being presented with less invasive suitable alternatives.  The surgery ultimately led to adverse effects including a requirement for countless corrective surgeries, severe pain, development of sepsis and numerous infections.  At one stage, when in severe pain he was refused admission and was told “it was not a hotel”.

The gentleman’s painful and disabling urological injuries impacted his quality of life, ability to work, mental health and relationships.  He has spent at least 68 nights in hospital as a consequence of same, with endless more outpatient appointments and more surgeries to come.  To document his injuries and loss, Cantillons gathered various expert reports from a urological surgeon and other experts including vocational, care, psychiatry and occupational therapy.

Liability was denied.  However, no details of the denial were outlined, contrary to the Rules of Court which specify that the Plaintiff and the Defendants set out their stall as part of the proceedings.

Ultimately the Defendants suggested that we meet for negotiations, a few weeks in advance of the scheduled trial.  The proceedings for this gentleman and related proceedings for his wife were successfully negotiated without the need to go to court.  In addition to significant compensation for the couple, the Defendants paid our clients’ legal costs.
