Settlement for Lady following negligent prescription of oral contraceptive

Orla Kelly and Angela O’Donovan in the Medical Negligence Department recently acted on behalf of a lovely lady who was negligently prescribed an oral contraceptive which was inappropriate for her, by her Consultant Gynaecologist.  As a result, the Plaintiff developed bilateral multiple pulmonary emboli. Thankfully she received treatment quickly which saved her life.  However, the pulmonary emboli had devastating consequences for the Plaintiff in terms of a prolonged hospital stay, time off work, deterioration of her respiratory function, mental health and need for long-term preventative anticoagulation and long-term monitoring.

Central to the case was the lack of informed consent obtained by the Defendant when prescribing the medication for the Plaintiff.  This is an area of medical law which is scarcely litigated in Ireland and therefore, required careful legal consideration, drafting and strategies.

Proceedings were issued and served in November 2022. The Defendants initially fought liability, and ultimately it was admitted a matter of weeks before trial.  The case settled out of court on the morning of the trial without the necessity to go to Court.

In addition, we also brought a case for her spouse for Loss of Consortium and this also settled out of court on the morning of the trial.

Thankfully we achieved a sum that the clients were happy with, which compensated them for their losses both past and future and will enable them avail of necessary medical treatment and therapies going forward.
