Settlement for Inspirational Young Woman with Cerebral Palsy

Karen Kearney, Tricia Sisk, April Wiseman and the team recently settled a claim for €5 million for a gorgeous client of ours.

We applied for and were granted a Section 27 Order by the Judge who approved the settlement and which Order serves  to protect our client’s  anonymity.

Our client, now aged 16, suffered a catastrophic brain injury during the course of her birth at a HSE run hospital and which resulted in her developing Cerebral Palsy which was diagnosed at the age of two.

Her parents had concerns about the care her mother had received during her labour and delivery and they asked us to investigate.

We conducted investigations, commissioned expert reports and thereafter prosecuted a claim against the HSE and succeeded in getting them to admit medical  negligence.

We secured an interim settlement of €1.5 million in 2019 when our client was aged 10. This was to pay for her past expenses and future care and therapies.

From day one, her amazing parents left no stone unturned in affording their daughter every opportunity to ameliorate the adverse effects of her diagnosis.

The interim settlement of €1.5 million was of huge assistance in this regard and as a consequence our client has achieved huge success in her chosen sport and is now an international athlete and hopes to represent Ireland in the forthcoming Olympics.

The €5 million will be put to further good use in helping our client fulfil her dreams and ambitions.

No  amount of money will ever turn back the clock for our client.

But she is inspirational.

She has a “get on with it” attitude.

She has met all of the challenges in her short life with grit and determination and a big smile on her face.
