Settlement achieved at mediation for man who suffered amputation due to negligence in Dublin hospitals

A Dublin gentleman and his wife contacted Orla Kelly and the team at Cantillons following a horrific series of events which led to the amputation of his leg from above the knee.
The background was that he was admitted to the Mater Private Hospital for an unrelated cardiac procedure and received TED stocking which were contraindicated due to his known peripheral vascular disease. He was discharged without the staff having noticed that he had developed a pressure sore on his left heel. Sadly, despite regular reviews by the public health nurse and antibiotics it failed to improve and worsened to the point where he was readmitted to Beaumont Hospital. There the negligence continued with a delay in attempting a revascularisation procedure, which would have saved the Plaintiff’s leg.
Expert reports commissioned by Cantillons confirmed the various failings.
Proceedings were brought and a claim was made for care requirements, adaptions to his home to make it wheelchair accessible, aids, medical expenses, and associated travel.
Ultimately the matter settled at Mediation thereby avoiding the need to go to trial. Hopefully learnings have been made by these sad events which changed the course of this man’s life and that of his family.
