Road Traffic Accident Claim Settled

Amy Connolly, assisted by Kate O’Toole and Rebekah Jefferson, of the Litigation Team at Cantillons Solicitors recently settled a case for a client who suffered significant injuries as a result of a road traffic accident.
On the date of the accident, our client was travelling to work when he was involved in a collision with an articulated truck. It was claimed that the articulated truck lost control as it approached the particular stretch of road where the accident occurred and skidded on what the Defendants claimed was black ice, causing the trailer of the truck to jack knife and collide with our client’s vehicle. Our client’s vehicle caught fire which was fortunately quickly extinguished by a local man who lived nearby. It was a very traumatic experience for our client who was subsequently cut out of his vehicle by the Fire Brigade.
Our client was transferred to Cork University Hospital where he underwent surgery for a fracture to his right arm and was subsequently transferred to Tallaght Hospital in Dublin where he underwent further surgery to repair a fracture to his hip/pelvis.
Proceedings were issued by way of High Court Personal Injuries Summons and the matter was set down for trial. Liability remained in issue throughout the case.
Ultimately, we entered into negotiations with the Defendants and we were able to secure a significant offer of settlement which was accepted by our client. Our client was hugely relieved, after a lengthy drawn-out battle, to receive such a favourable out of court settlement together with his legal costs which the Defendants also agreed to pay as part of the settlement.
