Over quarter of a million euro settlement for Farmer who developed clot as a result of misapplication of cast

Cantillons Solicitors recently settled a case for a Farmer who developed a clot in his leg following the misapplication of a cast on his leg.

 

The Plaintiff injured his leg while playing sports with friends in October 2013. He attended Kerry General Hospital to have the injury investigated and was advised following an ultrasound that he had torn his Achilles tendon. He was advised he would have to have his leg placed in an equinus cast for a total period of six weeks. He was further advised that this cast would need to be removed every fortnight in order to reposition his foot, with another cast applied thereafter. When the Plaintiff returned to Kerry General Hospital after two weeks to have the cast repositioned, he was advised that the cast would not be removed, and he should return in 4 weeks’ time to have it taken off. The Plaintiff returned in 4 weeks’ time, and was met by another doctor who was shocked to hear the cast had not been removed within the 6 week period. At this point, the cast was taken off, his foot repositioned, and a further cast applied for a period of two weeks.

During these final two weeks, the Plaintiff developed a clot in his leg which occurred as a result of the failure to reposition the cast (immobilisation) at fortnightly intervals as had been originally planned .The Plaintiff has been left with long lasting injuries to his leg as a result of this. Cantillons Solicitors negotiated a settlement of over quarter of a million earlier this year for the Plaintiff.
