Kerry boy with cerebral palsy settles case against University Maternity Hospital Limerick for €3.75m for failings in neonatal care

Orla Kelly and the medical negligence team acted on behalf of Kyle Flavin a minor, instructed by his parents.

They brought proceedings arising out of the failings in the care given to him during the first few days of his life in the neonatal unit in Limerick.  Extensive reports were gathered to support liability and also demonstrate his injuries and life-long requirements due to the medical negligence which we alleged caused a catastrophic brain bleed.  The HSE denied liability at all stages.

Mediation was unsuccessful and we went to trial.  An agreement was reached on the morning the case was about to commence and the terms of the settlement were ruled and approved by Coffey J in the High Court.

It was a difficult case and a hard-fought battle but thankfully we achieved a substantial sum of money to compensate Kyle and allow investment on necessary therapies such as care, physiotherapy and speech therapy to provide a better future for him.
