€7m settlement for child with cerebral palsy over substandard care in hospitals following his birth

The Plaintiff, through his father, brought High Court personal injury proceedings against two hospitals, in respect of avoidable catastrophic injuries he acquired in the neonatal period as a result of substandard medical care.
The Plaintiff has cerebral palsy, a severe intellectual disability, he cannot speak and requires full time care. The Plaintiff’s case centred on the management of an intestinal disease which he acquired in the days following his birth together with failures in his paediatric endocrine care. The case was listed for hearing to commence before Dublin High Court recently and resolved, following negotiations between both sides, before the hearing commenced on the first day of the trial.
An anonymity order was sought (and granted by the Court), on behalf of the Plaintiff, prohibiting the publication of any matter relating to the proceedings which would identify the Plaintiff.
This case highlights the severe and lifelong injuries that can be caused to patients when medical care does not meet the requisite standards. The injuries our client acquired as a result of substandard medical care has also had enduring consequences for his family where his parents have had to become full time carers to their catastrophically injured child.
While no amount of money, will compensate our client for the severe and avoidable injuries he wrongly acquired in this case, it is hoped the settlement will give the Plaintiff and his family some comfort in being able to pay for his future care and therapy requirements.
