€23million total settlement for young Cork boy who was brain damaged at birth
Posted in News on Tuesday, November 5th, 2019
The medical negligence team at Cantillons including Orla Kelly and Ernest Cantillon were delighted to assist this deserving little boy Lee Gibson and his devoted mother Aileen and family in achieving a fantastic, ground breaking settlement totalling €23million.
Lee has now been awarded a final settlement, which brings his long journey through the court system to an end. He can now focus on putting the money to good use, which he has been doing with the interim payments to benefit from a range of therapies, to improve and prolong his life. Lee is a Ward of Court and the Wards of Court Office will continue their excellent work in managing his assets, reviewing the monies spent and assisting Lee and his mother for the duration of his life.
Aileen Gibson his mother, gave this statement yesterday following Court:
Thank you to everyone who helped us along our long and difficult journey since Lee was born in 2005.
In particular, I want to thank my solicitors in Cantillons in Cork and my barristers.
In 2015, we were awarded an interim payment of €2million and a further payment of €1million in 2017. These payments allowed us to give Lee all the recommended therapies such as physiotherapy, SLT and OT and allowed us to build a purpose-built, specially adapted house.
Lee and I are grateful to the Wards of Court and the Courts for their assistance at all stages.
Now, today we have achieved a final settlement of €20million, for which we are grateful.
However, I must say that today is bittersweet, all the money won’t change what has happened to Lee, which should never have happened and we will have to live with that pain forever.
The monies received will all be spent for Lee’s benefit and allows us to give Lee all the therapies and care he requires for the duration of his life and to plan our future without the need for future litigation.
