€15 Million Settlement for 9 year old boy from Kerry

Cantillons Solicitors were instructed by the parents of a young boy from Kerry in relation to the care that was afforded to him and his mother during the course of his birth at Cork University Maternity Hospital.

The Plaintiff and his mother were under the care of a Consultant Obstetrician and Gynaecologist at Cork University Maternity Hospital for the duration of her pregnancy, labour and delivery. The Plaintiff’s mother was admitted to Cork University Maternity Hospital for an induction of labour on the 11th of August 2008, due to pregnancy induced hypertension and generalised itchiness.

During the course of the labour, the Plaintiff got into difficulty. Abnormal CTG traces were not acted upon, until it was too late. A crash caesarean section was called for and the Plaintiff was delivered in very poor condition.  He required urgent resuscitation and therapeutic cooling. Unfortunately, the Plaintiff suffered irreversible brain damage as a result of the failure to act on the pathological CTG trace.

If the Plaintiff had been delivered earlier, the near total acute hypoxic event could have been avoided.  Liability was denied by the Defendants for a period of 8 years. A €15 million settlement was negotiated on behalf of the Plaintiff and an apology was requested and delivered by Cork University Maternity Hospital as part of the terms of settlement.
