Deserving settlement for Client injured when a waitress caused the contents of a teapot to spill on her

The Litigation Team at Cantillons recently negotiated a significant settlement for a client who suffered burns, resulting in significant scarring, when a waitress allowed scalding hot tea to spill on to her back from a teapot she had balanced on the back of our client’s chair. An application was made to PIAB in the usual course and given that the new PI guidelines offer guidance on the issue of burns and scarring, PIAB provided an assessment of damages in the case. Given the extent of our client’s pain and suffering, Cantillon’s believed the assessment was insufficient to compensate our client and based on Cantillons’s advices, the assessment was declined. A fair and appropriate settlement, representing a very significant uplift on the PIAB assessment which also included the Plaintiff’s legal costs, was achieved by the team at Cantillons within weeks. Our client was delighted to have the matter concluded in such a timely manner whilst avoiding the necessity of a court appearance.
