Jody Cantillon and the Litigation Team at Cantillons Solicitors recently successfully obtained significant compensation for a client who suffered injuries when she was assaulted while carrying out her duties as a Social Worker.
In summary, our client was working for a State Body which oversaw the placing of children in care. While in one of the facilities run by the State Body our client was assaulted and suffered significant psychological injuries as a result.
The matter was referred to the Personal Injuries Resolution Board (formerly PIAB) but our client’s employer refused to allow PIRB to deal with the matter. An Authorisation issued permitting the matter to proceed through the Courts. Thereafter, a High Court Personal Injuries Summons issued.
A detailed report had to be obtained from an Expert Social Worker and extensive documentation had to be reviewed in order to build the case.
Despite the Defendant entering a full Defence, denying any liability for the assault, the matter ultimately settled (without our client having to go to Court) for significant compensation.
