COMPENSATION FOR SINGLE CAR ACCIDENT

Jody Cantillon in the Litigation Team at Cantillons Solicitors recently successfully represented a client who suffered injuries (including whiplash injuries), loss and damage as a result of a car accident.
The circumstances of the accident are somewhat unusual in that our client was driving their car along a busy and well known Cork motorway when she came upon excess water on the motorway. The motorway in question was newly constructed. Given the advancement in road construction over the years, such excess water should not have been on the road and posed a significant risk and danger to motorists, including our client. Unfortunately, our client was unable to avoid the excess water and ultimately lost control of their car and collided with the crash barrier.
Ordinarily, car accidents involve one car crashing into another. In this case, Cantillons Solicitors undertook extensive research into previous incidents and accidents on the road caused by water and also research into the construction layout and maintenance of the roadway.
Our research uncovered numerous complaints to about excess water on the roadway. It was also clear from the research that maintenance of the drains (which would take the excess water off the roadway) was not carried out.
Our client instructed us to bring a Personal Injury claim. The matter was originally submitted to PIAB (formerly the Injuries Board). However, it was soon released out of PIAB given the complexity of the case.
High Court proceedings issued but the case settled for a significant compensation pay out, without our client having to go to Court. As part of the settlement, our client’s legal fees were paid by the Defendants.
