COMPENSATION FOR MINOR INJURED IN PARK

Jody Cantillon, and the Litigation Team of Cantillons Solicitors, recently successfully obtained compensation for a minor Plaintiff, who suffered injuries, due to a fall whilst using a public park.
Our client was walking through a public park when, due to a defect in the footpath, she fell and suffered serious injuries.
The matter was referred to the Personal Injuries Assessment Board (PIAB) (formerly the Injuries Board). The Defendant refused to engage with the PIAB process and the matter was released by PIAB.
Cantillons Solicitors instructed a firm of Expert Engineers to carry out an inspection of the locus and to prepare a report. The Expert Engineers confirmed that the Defendant was liable for the accident.
Circuit Court Personal Injuries Proceedings issued. The Defendant denied any responsibility for the accident. The matter was listed for hearing. On the day the case was due to commence, the Defendant agreed to pay compensation for the injuries, loss and damage suffered. The matter settled without the parties having to go into Court.
