Jody Cantillon and the Litigation Team at Cantillons Solicitors recently successfully represented a client who suffered significant injuries following the use of a defective Cherry Picker.
Our client was operating a Cherry Picker. While raised at a height, with our client within, the Cherry Picker malfunctioned and crashed to the ground. Our client suffered serious personal injury, loss and damage as a result.
An application was made to PIAB (formerly the Injuries Board) and PIAB, due to the complexities of the injuries, declined to assess the matter. Thereafter, High Court proceedings issued. While liability was initially contested, due to pressure applied to the Defendant by Cantillons Solicitors, liability was ultimately admitted.
The matter was somewhat complicated due to our client’s pre-existing medical condition which made their injuries worse.
The matter was listed for hearing before the High Court. The case settled for significant compensation without the need for our client to give evidence in Court. The Defendant was required to pay our client’s legal costs.
