Jody Cantillon and the Litigation Team at Cantillons Solicitors recently obtained compensation for a client who suffered injuries when, during the course of employment, he was struck by a tree being felled on a construction site.
In summary, our client was working on a construction site surrounded by trees. As part of the works, trees had to be felled. A fellow employee of our client cut down the tree without due care and attention and it struck our client causing significant injury, loss and damage. Investigations revealed that both the our client’s employer and the main contractor had a liability for the accident.
The matter was submitted to the Injuries Resolution Board (previously PIAB) but the claim was released as the Defendants denied liability. Thereafter a High Court Personal Injuries Summons issued.
Aside from seeking compensation for pain and suffering, a significant claim for loss of earnings and future medical treatment was made.
Despite full Defence, the matter ultimately settled without our client having to go to Court (for significant compensation).
