Case settled for record amount for Tadgh Costello, an 11 year old boy, who suffered devastating brain injuries at birth

In March 2017, Cantillons settled a case for €15 million in final settlement of this High Court birth-injury case. It brings to €17.8 million the total awarded to Tadgh Costello; the highest award on record in the State. Tadgh’s mother, Mary sued the HSE over the circumstances surrounding the birth of Tadgh in Kerry General Hospital on May 25, 2006. There was up to a two hour delay in delivering Tadgh and a failure by the hospital to treat his birth as an emergency case, which, tragically, caused Tadgh to suffer a severe brain injury. Tadgh was later diagnosed with mixed dyskinetic cerebral palsy. As a result of the negligence, Tadgh is wheelchair bound, cannot talk and is dependent on others for all aspects of daily living; he requires 24/7 care.

Notably, the consultant obstetrician in question expressed remorse and regret over the events which led to Tadgh’s brain injury at a private meeting with his parents soon after his birth. In spite of this admission, it took nine years for the HSE to admit liability.  In March 2015, Tadgh received an interim payment of €2.8 million and an apology from the HSE under an interim settlement of his case.

In a statement read after the ruling, Tadgh’s parents stated that: “We are grateful that the legal system prevailed to see that justice was done today for Tadgh”.
