The Litigation Team recently represented a client who required significant orthopaedic surgery following a road traffic accident. While her fractures healed well, she continued to experience constant pain and restricted mobility. Her restricted mobility arose due to a combination of the Plaintiff’s loss of confidence and Chronic Regional Pain Syndrome. Her medical practitioners attributed both factors as arising as a direct result of the accident. However, despite the medical evidence to hand, the insurance company disputed the extent of the Plaintiff’s ongoing difficulties. Their Solicitors initially refused to accept that she ought to be entitled to compensation for house adaptations and mobility aids, and for future loss of earnings whereby she had hoped to extend her contract of employment beyond the usual age for retirement.
