20 Year Old Disabled Athlete Awarded €5 Million
Posted in News on Wednesday, October 4th, 2017
On the 4th October 2017, Pat Daly and the medical negligence team settled the case for Martin Coleman for injuries sustained during the course of his birth at St. Finbarr’s Hospital 20 years ago. Martin’s mother developed an acute obstetric emergency in the form of a cord prolapse during the latter stages of the labour. We claimed that the labour was negligently managed and that Martin should have been delivered by way of a caesarean section prior to the cord prolapse occurring. Secondly, we claimed that the management of the cord prolapse was negligent. As a result of the negligence Martin sustained a brain injury which has impacted on his ability to carry out every day activities of living, and he will need assistance for life. The case was extremely challenging, both medically and legally. The case was fully defended and settled on the second day of the trial for the sum of €5 million. Although the compensation will not reverse the damage caused, it will help to ease the family’s burden in providing care for Martin going forward.

* In contentious business, a Solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement. Many Personal Injury Solicitors portray themselves as “no win no fee Solicitors Cork”. This term can be misleading and it is essential that you discuss fees with the Personal Injury Solicitor you ultimately choose. At Cantillons Solicitors, we are entirely transparent.
