2. Submit Your Claim Before The Deadline
In Ireland, the timeframe in which you can make a Personal Injury Claim is strictly guided by the Statute of Limitations. Generally speaking, you have 2 years from the date of suffering the injury, loss or damage to make a claim.
Exceptions to the 2 years rule are limited and can include:
- Where a child (someone under the age of 18) has been involved in an accident, the 2 year time frame does not begin until the child’s 18th However, the child parents can bring a claim on behalf of the child before they turn 18, should they wish to do so. The parents of an injured child can decide to wait until the child turns 18 to submit a claim (although this is not normally advisable as, for example, some witnesses may no longer be available or may not have a good recall of events).
- Where an illness or injury caused by an accident or incident does not become apparent until a later date. In this case, the 2 years time frame begins from the date upon which the illness or injury could reasonably have been connected linked to the accident in question.
- Where a person is under a mental disability.
